National Bank of Kenya fines former executives $50,000 over fraud

Eight former senior executives of the troubled National Bank of Kenya have been fined $50,000 and banned from holding office in listed companies for up to 10 years. They are alleged to have cooked books and stolen more than $10 million from the lender. The Kenyan capital markets regulator says its investigations found the officials liable for misrepresenting the bank's financial statements for the periods ended June 30, 2015 and September 30, 2015. The Capital Markets Authority has recommended to the Office of the Director of Public Prosecutions, the prosecution of some of the senior managers and further criminal investigation of additional individuals. The last three months have been dominated by tariffs talk and trade wars. Secondarily, there are concerns about inflation and rising rates. On the first point, trade wars are probably bad for pretty much the entire market but in particular for industrial and global multinationals. I don’t think that we’ve really been able to avoid that negativity. But on the second point, inflation and interest rates, our focus on companies that have pricing power, in other words, companies that can increase their prices as their input costs rise has really led to strengthen the holdings of our funds. So we’ve typically been underweight resources and we don’t own any energy or mining at this point and those happen to have been two sectors that have been quite weak this year and certainly in the last quarter. So that has been a positive for the relative fund performance. We are also lacking exposure to the interest sensitives in particular real estate, utility and telecoms. We don’t own those as they tend to be regulated, they tend to have stretched balance sheet and don’t grow as much as we like. On the flip side or as a result, we are overweight industries and consumers. So as very long-term investors that use a bottom-up approach, we don’t really spend a lot of time thinking about market or macro outlooks. But we do foresee volatility as we have seen in the past and we try to take advantage of that by buying stocks when they are cheap and selling our holdings when we think they are a little bit expensive. In terms of an outlook, we probably see mid-single-digit returns given that we are kind of late in a long bull market.

The preferred share market performed very well in the third quarter, gaining 1.5%. Fixed-reset preferred shares once again outperformed, with a 1.8%return. I’d say the main reason for this strong performance, which is the best quarter of the year to date, is that the Bank of Canada raised its key rate in July, and announced that it could continue with this rate hiking strategy with another potential increase in October. This resulted in an increase of around 25 basis points in 5-year yields, which is highly positive for fixed-reset preferred shares, especially those trading at a discount. I’d also say that the credit tone was particularly favourable over the quarter. Corporate bonds performed well in Canada and the United States, where they generated a particularly strong showing for the quarter. Their performance could have been even better, but there were few new issues, particularly bank issues, which put some pressure on this sector. Flows were somewhat more mixed over the quarter. We therefore saw certain sellers taking profits. We continue to favour fixed-reset preferred shares or floating-rate issues in the portfolio and we are leaning toward those trading at a discount. For us, “at a discount” means shares trading under 24 dollars. More than half of the portfolio is invested in these types of securities, which is more than the preferred share universe. In the universe, it’s around 40% so we’re running about 10% higher. We even have more than a solely fixed-reset mandate would have (around 45%). This is not necessarily because we’re hoping that rates will continue to go up. Even if rates remain unchanged over the next year or even edge down a bit, we have some measure of protection. What changed in our positioning this year, for instance, is we’re not necessarily focusing on those trading at the largest discounts, but rather on those with an average reset spread in the neighbourhood of 250 to 350 bps vs Canada bond yields, which will reset in the next two years. That is really what we’re focusing on right now. In terms of sectors or companies, I’d say that Enbridge is still our top pick. We also like companies like BCE, especially the oldest structure and companies like Brookfield Renewable, which still have attractive valuations. In terms of banks, what we like, is not new issues, but those still trading, with a $1 discount and that will reset in the next two years or so. That’s where we’re really finding the most attractive opportunities for the moment. We expect a solid performance from the preferred share market over the next year. A performance that could be in the 5% to 7% range for total return. We expect growth in both Canada and the United States to remain above potential next year, with inflation that we also expect to be around 2%, so a bit above the target. It could mean that central banks will continue to gradually raise rates in the coming quarters. Obviously there’s still risk: The trade war between China and the United States appears to be taking a turn for the worse again. Emerging markets underperform when the U.S. dollar is strong, so that could still continue in the coming months. Troubles in Italy also aren’t over yet. So, there will be volatility, but we still think that markets and fundamentals, both in Canada and the United States, will remain strong next year, so the credit tone will be strong. As such, preferred shares should benefit from this situation.

CMA fines Solomon Alubala former head of treasury at National Bank of Kenya Sh104.8 million

In a move that is set to break records ,the capital markets authority has fined Solomon Alubala, a former head of treasury at the national bank of Kenya, a whopping 104.8 million shillings, the largest ever individual fine at the Nairobi securities exchange, for his role in an alleged cash siphoning scheme at the bank. According to a statement from the CMA, Alubala has been fined Sh 104.8 million, being 2 times the amounts so far traced into his hands from the embezzled funds. CMA has also sought restriction on two properties associated with him which were allegedly purchased with the embezzled funds. At the same time, the capital markets authority has taken administrative action against other former national bank of Kenya board members and former senior managers who served at the bank as at December 31, 2015 for the alleged misrepresentation of financial statements and embezzlement of funds at NBK. The Federal Reserve is one of the cornerstones of the American economy, and with good reason: it performs key functions without which the modern financial sector could not exist. The Fed, however, is surprisingly new, having only emerged during the early 20th century. For comparison, the British and the Dutch have had central banks since the 17th century and they were one of the key factors in sustaining their vast overseas empires. But it's exactly this imperialistic history that made the Founding Fathers reluctant to apply the same method to the United States. Of course, central banks were vital for a healthy economy and without one, the US suffered frequent and deep recessions for many decades before things got bad enough to force the hand of Congress. The creation of the Federal Reserve was not smooth, of course, and it was an exercise in political compromise. The structure Congress crafted with the help of bankers like J. P. Morgan was unique: twelve regional federal reserve banks would regulate private banks on a local level, with a single board of governors appointed by the President to keep everyone in line. What's most surprising is the structure of these regional reserve banks: they're incorporated as private entities and have shares, which every bank they regulate must buy by law. These shares can't be traded though, and their price is fixed to $100. They do, however, carry a lucrative dividend, which was created to entice the bankers of the day to participate and support the fledgling system.
