Today we are going to continue discussions on family law and talk about child support guidelines. We are pleased to be joined by John Schuman of Devry Smith. When two people are trying to deal with child support and they don’t like the guidelines set out. Can they themselves do something differently? Technically yes! But in reality it is almost always NO. The child support guidelines are mandatory. If you have an agreement for child agreement unless the agreement actually benefits the child more than child support guidelines. What about parents who don’t want to share income from the second job because they think it is fun money? In an agreement where the parent is required to pay less than the child support guidelines, either parent likes to go to court, the judge is going to throw that agreement. Even if was agreed in faith! It changes from income levels, province to province, but it is based on income spent on your kids when you were staying like a normal family. How about in a situation where one parent leaves the other ex-spouse with the home in exchange for lower child support payment? Is that possible? That is a really good deal if you are a recipient and a terrible deal if you are giving a home. No family lawyer will recommend. If you are paying support, you will never get a lawyer who would agree to this agreement and that’s too dangerous down the road. Supreme Court has made it pretty clear, if you are hiding anything in increase in income, a judge can order support backward. The guidelines for Shared Custody are going to be different. Parents live equal time and in that situation both parents support as per the guidelines. The judge may change the guidelines if one parent is earning more than the other parent. The expenses can be shared proportionately. Is it possible to agree something different in the guidelines? Yes, if it benefits the children more and not less than guideline. Custody issue – Can a parent avoid paying support? This may only happen when a parent is not a good parent or they just want to get away. The judges want the kids to know their parents even if they are not good. The child support is right of the child and not right of the parent. How do you determine spousal support? How is support determined in the state of California? There is a California mandatory guideline which the courts are to follow in the state of California. In child support specially is very detailed and mandated by the state legislature. Spousal support can be a little less mandated and can vary from county to county. In my San Diego county office, located in Carlsbad there may be variations that I see in my Riverside county office, which is based out in Marrieta. Child support in particular can last until the child is 19 years of age or 18 years of age and has graduated from high school. So it is a very important process for someone who is going to be receiving child support or paying it to have this determined by professional to decide what is best for you. Child support can also be pay ordered and paid through college if it can be agreed between the parties. Most likely in all counties of the state of California, child support add ons would be half of child care, half of uninsured medical expenses. Spousal support is a different type of support than child support. It is used to equalized the standard of living that the parties had during the marriage. Most of the time, we see half the length of the marriage has a time period that a spousal support would be paid. Although if a marriage is 10 years of duration or longer becomes a long term marriage. A long term marriage is handled more differently in the state of California and in all counties. You will consult with your local attorney as to what differences those may be. In San Diego county out of my Carlsbad office, we can give you an idea of what support would be. We could use a support calculator that we have available on our computers. They are used by the courts throughout the state and we can give you an idea, a very good idea of what your support level would be. Whether you are paying or receiving. In the state of California there's support software used by the courts. That support software is available in my San Diego county office and in my Riverside county office. How Base Child Support is Calculated In this video we discuss how the Child Support Table in the Guidelines sets out the amounts of support to be paid, depending on the "gross income" of the paying parent and the number of children that the support order covers. Gross income means before taxes and most other deductions. The amounts to be paid are based on the average amounts of money that parents at various income levels spend to raise a child. In simple cases, the table alone will determine how much money will be paid. In more complicated cases, the table is used as the starting point. There is a different table for each province and territory. If both parents live in Ontario, the Ontario table applies. Also, if the paying parent lives outside of Canada and the parent with custody lives in Ontario, the Ontario table applies. But if the paying parent lives in another province or territory, the table for that province or territory is the one that applies. You can get a copy of the Child Support Table for Ontario by phoning 1-888-373-2222. Or you can visit the Department of Justice Canada's web site at www.canada.justice.gc.ca/en/ps/sup and click on "Simplified Federal Child Support Tables" to find the table for each province and territory. The table sets out the amount of support that must be paid at different income levels from $8,000 to $150,000, depending on the number of children. A base amount is given for every $1,000 increase in income, along with a way to calculate amounts in between. There is also a Simplified Table where you can look up the paying parent's income to the nearest $100, without having to do any calculations. Sometimes, a judge does not accept a parent's statement of income. Instead the judge uses an amount of income that is reasonable based on things such as the parent's work history, past income, and education. The judge will then apply the table to that income. A judge might do this if the parent: • fails to provide the required income information • is deliberately unemployed or under employed, or • is self-employed or working "under the table", and there is reason to believe they do not report all of their income Before the Guidelines came into effect, judges had more flexibility in deciding the amount of support. Now, in simple cases, judges must order the amount shown in the table. Judges can order different amounts, but only in special cases. And they must use the table amount as a guide.

We first always start off with your gross income and your spouse's or ex spouse's gross income. Obviously we can also be speaking about a paternity case where it is mother and father instead of husband and wife. We must always look at your gross income and the other parent's gross income. One of the items that we have to consider is which parent or are both parents providing health insurance benefits for the children. Now when your attorney asks you for this information please provide to them what you would be paying when it is employee only and what you are paying for employee plus dependents. This is going to be a different calculation than what is deducted from your paycheck if your employer is the one providing health insurance for you and your family. Your attorney will then be able to calculate how much it costs for you to provide health insurance for the children only. This amount will then be placed in the child support worksheet. The next item that we will be looking at is how many overnights will the non-custodial parent have with the children. What is important is that you and the other parent and the attorneys work together to make sure that the financial needs of the children are being met. It is not the goal or it should not be the goal for any of the parents to reduce their child support for their own financial gain. The Court is going to make sure that the best interests of the children are upheld. That is the goal. In Indiana the statute has recently changed where child support is terminated when each child of the marriage or of the relationship turns 19 years of age. Termination of child support when a child turns 19 is not automatic especially if you have an Income Withholding Order where your employer deducts your child support from your weekly or biweekly paycheck and sends it to the Clerk's office. You need to seek an attorney's advice and assistance a few months at least prior to your child turning 19 years old. Although child support may terminate when your children turn 19 years old that does not mean that your financial responsibilities under a Court Order terminate as well. There may be college expenses that you have been previously ordered to pay or the other parent may choose to bring this in to your particular circumstance if you are terminating child support. Once the child turns 19 there can be a concurrent order regarding your contribution as well as the other parent's financial contribution towards your children's college expenses. College expenses can include not just tuition and room and board but also health insurance, car insurance, school supplies, parking passes and anything else that the Court feels the child needs to complete their college education. Issues regarding child support are very fact sensitive and since I strongly suggest that you do not compare your case to others to come to your own conclusion, you should seek the advice of an attorney to discuss your specific circumstances so that you can both come to a conclusion of how you should proceed. Understanding Child Support or Alimony ? When a couple divorces, the spouse with the higher income sometimes pays money to help support the spouse with the lower income. This is called "spousal support". The entitlement to spousal support, the amount, and duration of payments depends on a variety of factors, including: - The length of your relationship - The income earning potential of each person - Roles during the relationship - Health of each person - Economic impact of the separation on each person - The property of each party - Age of each spouse - If children are still at home Ten important facts about Spousal Support: 1. Before determining the amount of spousal support to be paid, first determine the amount of child support. 2. Spousal support that is paid monthly is tax deductible for the person paying it and the recipient must pay taxes on it as if it was income. 3. A lump sum of spousal support can be paid instead of monthly payments. 4. Lump sum payments of spousal support are not tax deductible so this needs to be taken into consideration when determining the amount. Generally, spousal support is paid somewhere between 1 year for every 2 years of relationship to a maximum of 1 year for every 1 year of relationship. So, depending on your circumstances, if you have been married 10 years you might receive spousal support for between 5 to 10 years. 5. If you have been married for more than 20 years, the potential for spousal support will always exist. 6. If the recipient's age plus the years of marriage exceed 65, then spousal support may be payable forever. 7. Common law partners can seek spousal support, but only if the relationship lasted more than 3 years or you had a child together. 8. The recipient of spousal support has an obligation to use their best efforts to become economically self-sufficient as long as it is practical to do so. If they do not, it is possible for an income to be allocated to them and the amount of spousal support is accordingly decreased. 9. The payor of spousal support cannot quit a job or become voluntarily under-employed to avoid paying spousal support. 10. Spousal support is paid based on the realistic potential to earn income even if you choose to do otherwise. Since a mortgage principal gradually reduces are you make the monthly payments, the interest accrued reduces as you make payments. This make is so that calculating equal payments of the life of the loan a bit difficult. A brute force method would be to just calculate every payment for the life of the loan and make sure the payment amount results in a 0 payment at the end. In contrast, one can just also use a pre-calculated formula for this. There's an error in this video. The (1-r)^n term should be replaced with (1+r)^n. The formula in the spreadsheet is correct. Calculating the Equalization of Property in a Divorce: In Ontario, the Family Law Act uses a formula to determine how much needs to be paid by one spouse to the other so that you and your spouse end up with the same net property upon separation. The formula is illustrated below: + Add up your assets on the date of separation ­- Subtract your debts on the date of separation - Subtract any gifts from third parties, inheritances or proceeds from a personal injury claim received during the marriage which were kept separate and are still in existence on the date of separation - Subtract your assets less any debt you had on the date of marriage = The resulting number is called your Net Family Property (NFP). Your spouse does the same calculation. If your Net Family Property number is higher than your spouse's number, you owe half the difference so as to make the NFP's equal. For the past five years the states has only collected about 65 percent of the money owed. According to numbers provided by the N.C. Department of Health and Human Services, almost $815 million dollars in court-ordered child support was due in 2014. That same year, more than $280 million went unpaid. “A lot of it is because the non-custodial parents don't have jobs,” explained Mary Flounoy, who runs the child support department for Durham County. She says they've collected about 69 percent of the current support that's due. “We intercept tax refunds, driver's license suspension, passport denial, and we also report to the credit bureau,” explained Flounoy. But even with a court order to pay child support, payments aren't being made. Flounoy said the problem still goes back to enforcement because of how easy it is for people who don't want to pay to stay under the radar. “People call us all the time and say I know he lives at that address but if we can't get them served, we don't have a case,” explained Flounoy. Local sheriff's offices are tasked to carrying out court orders, but Flounoy said since they are civil cases, there isn't much they can do. “They go and ring the doorbell and if he or she is not there, that's the end of that. Unless we can find a new address or new location,” Flounoy said.

Under NC child support laws, child support terminates upon the minor child reaching the age of 18 or graduation from high school, whichever occurs last, but in no circumstance would it be continued past the age of 20. So, whether you have to pay child support now, that will not continue after high school. I've had many clients ask, "Do I have to pay for college?" Well, in North Carolina, the judge cannot order that. That is certainly something you can agree to pay and certainly something you may be morally obligated to pay, but legally, you will not be obligated to do that. In child support, the court will also order insurance coverage. That, too, stops regardless of whether federal allows, that stops at age 18 or graduation from high school, too. But understand child support doesn't stop automatically. The burden is on you to file the motion to terminate it, and if you do not file that motion, it will continue to accrue. A couple weeks ago I published my first version of this Tesla Model 3 Price Calculator that showed what your overall cost would be for a Tesla Model 3. Since then I’ve had almost 100K of you use that tool and I’ve received tons of feedback. A big question left unanswered with the previous version was what the monthly charging costs would be. This lead me down a path to build a calculator specifically for that. Along the way, I realized that I should instead make this new calculator more comprehensive so I went back to the drawing board. So I built a monthly charging calculator for a Tesla Model 3. After finishing the Model 3 charging cost calculator, I started work on adding up all the other expenses you might encounter and which ones I could reliably estimate. So in addition to the overall cost and monthly charging amount, I built a loan calculator so you can see what you'll pay each month for the loan as well. Towards the end, I wanted to include things like taxes, delivery fees, and any incentives you might receive for buying an EV, so I added options for all of this towards the end. To get started calculating your monthly cost of owning a Tesla Model 3: First, you need to configure your Tesla Model 3 with the upgrades you want, color and wheel choices, as well as your tax rate and doc fees. If you’re in the US, these will auto populate. If you’re outside the US, you’ll want to update these to match your location. Next, you’ll need to enter your loan information. Here I’ve calculated the taxes and fees in addition to the purchase price of the car and auto-filled that as your loan amount. You'll want to update this if you don't plan on financing the full amount of your Tesla Model 3. I’ve also defaulted it to the typical five-year loan term and the current 4.5% interest rate we’re seeing the US. If either of those doesn't match your situation, you’ll want to update before continuing. From there I need to know your driving habits to calculate your monthly charging cost. I’m assuming here you’re charging at home with a 240v NEMA 14-50 outlet. There are other options, but for this, I wanted to keep it simple. I’m also not factoring in any free supercharging Tesla may offer since we don’t know those details at this point. Your driving style also affects the amount of energy your Tesla’s efficiency so if you tend to have a heavy foot when driving you’ll want to update that. Next, I wanted to include a monthly insurance cost and any incentives you may receive. Since Insurance prices can vary widely depending on your location and situation, I defaulted it to $120 per month. Feel free to update if you have a better estimate. And lastly, I have a field here for any incentives. This is last because most likely this won’t affect the monthly cost. Let me explain…. In the US, the federal tax credit only reduces your tax liability, that is, how much you owe to the government. The IRS isn’t going to write you a check here though. So if you make less than about 50,000 USD, you’ll likely not be able to take full advantage of the credit. Since the credit is applied when you pay taxes, the following year, it won't affect the purchase price of the vehicle nor will it affect the monthly payment. In fact, when researching I couldn’t find many examples where any incentives offered reduced the purchase price of the vehicle. This is why I include the incentives at the end, to give you a “net cost” of your Tesla Model 3, even though it doesn’t change your monthly cost. Once you’ve made all your choices it’s time to see the results, click the big button there and get a breakdown of your Monthly Costs, Charging Details, and Net Costs of owning a Tesla Model 3.
