What happens if you don't pay a bank loan? | By Ishan [Hindi] First thing you have to understand that bank would not foreclose the loan even if you defaulted on one or two EMI payments. In fact foreclosure has always been the last option which banks wants to exercise. But yes if you continue to default for 3 months then there is a high probability that bank will seize your property. Banks have their set procedure in such cases. They don’t bother you after the first EMI default, but when you don’t pay 2 EMIs consecutively, they will send you a reminder to pay. It is only after 3 consecutive months of default that banks treat loan as NPA. Thus after 3 defaults banks can enforce, “The Securitization and reconstruction of financial assets and Enforcement of Security Interest act’2002” ( SARFAESI)” and start the process of recovery of property/dues. After three months bank will send you a legal notice and ask you to repay the dues. If you don’t repay at this stage too, then after two months (i.e. five months from the first default) bank will send you notice that it has valued the property for certain amount and will be auctioning the same. Auction date is set for generally 1 month after the date of notice. You have to understand that bank itself does not want to go through this cumbersome process of auctioning and wants to settle things as soon as possible. If you look at the process, then banks give sufficient six months of time before auctioning the house. Within these six months you can approach anytime and try to settle the things out with bank. Freelance Digital Marketing Life throws up some interesting challenges. So for this month I wanted to speak about 1 specific topic. New people, from up and down the country who are totally new to me. Normally, clients for digital marketing work come in via word of mouth recommendations so they’re not complete strangers. Now here comes the interesting bit. Invoicing is not a fun topic but is super important. If freelancers don’t invoice then freelancers don’t get paid. What I wanted to talk about was that one of these clients who I didn’t know hadn’t paid their bill. Normally there can often be a very good excuse. People go down ill, people go on holiday. But in this instance the client I was working with had disappeared – and it sucked as it was the first time I’ve experienced so far when a client hasn’t paid. So if you have a client or supplier who is late in paying their bills then this is the process I went through which hopefully might help some of you out there. Firstly, I made sure I contacted them and made it clear that if I didn’t hear from them I would escalate the situation. Don’t keep waiting for an answer though. Next, and this applies to UK law – it depends on how much the invoice is for but if your invoice is late you can charge a late payment fee as well as interest on how long the invoice hasn’t been paid for. I updated the invoice and sent it back to client highlighting that if the payment wasn’t made then it would be escalated further… If it came to it I could have taken the client to small claims court. The amount you have to pay for starting the procedure varies depending on how much you’re invoicing for. Fortunately though I didn’t have to do this as they paid up – but it was still a frustrating, time consuming process. At the same time I did put a message out on LinkedIn and got some really positive feedback on other ways I could have approached it. As a result of this there are a number of organisations and individuals who will work to collect the amount due and take a cut of the invoice so you only have to pay on completion – but through LinkedIn there are plenty of horror stories out there from other freelancers. Although a lot of it was my stupid mistake I’ve decided that in the event of taking on a new client who isn’t known to me will mean that I invoice 50% of the bill up front and the remainder on completion. It also means that the work then becomes guaranteed. It also means that I’m going to be updating my business terms and conditions to cover myself. In an ideal world I don’t want to be that guy lays down a heap of terms and conditions when at the end of the day the client wants to work with me and I want to work with them. However, if a client doesn’t pay then that puts my livelihood on the line and that isn’t something which I am willing to compromise. Amortization is the term for paying down the cost of an asset at a certain rate. In the real estate world, typically when we're referring to amortization we are referring to the rate at which we are repaying the principal on a loan back to the lender. Let's take a look at this graphically. Imagine that we have our loan amount and time, let's say this is 30 years. If a loan is fully amortizing, it is paid off down to zero at the end of the life of the loan. It starts out at whatever the loan amount is and a fully amortizing loan is paid completely off. The most common example of a fully amortizing loan would be your standard 30 year fixed rate home loan. You have an equal payment that goes every month for the entire life of the loan and at the very last payment the loan balance is zero. Sometimes we have what's called a partially amortizing loan and that would be when the loan is paid down but not all the way. In the case of a partially amortizing loan, we end up with a balloon payment. Typically when you find a partially amortizing loan it is often because payments are amortized over say 25 or 30 years, but the term of the loan is shorter and we have a balloon payment say after maybe 10 or 15 years. The next type of structure is no amortization. In other words, not paying any principal at all, we're simply paying interest only. The loan balance at the beginning of the loan never changes, it stays constant throughout the life of the loan because payments are only made to cover interest and not paying down any principal. Finally, sometimes we run into what we call negative amortization. Typically negative amortization occurs when payments are not sufficient to cover even the interest that has accrued each month or each period and any unpaid interest is capitalized onto the balance, thereby increasing the loan amount and the loan balance over time. In today's video we are talking about capitalized student loan interest. When a loan is capitalized, it means the unpaid accrued interest is added to the principal. Then the interest starts earning interest. Talk about the wrong kind of snowball. Did you know for unsubsidized student loans there are many times throughout the life of a loan that interest can be capitalized: -Out of grace/ Out of school -End of deferrement or forebearance -When a loan is in default -When a loan is consolidated AND when you switch between payment plans. This is where they got me. I didn't realize that going between the different income based repayment plans (IBR, REPAYE, ICR etc) counts. So last year, when I went from an IBR plan to another IBR plan- guess what happened? WHAM! Interested capitalized. I was soo upset but I promised myself that wouldn't happen again. Knowledge is power. I share this information so that we make informed decisions. I know there are times when a forebearance or deferrment is necessary due to circumstances but I've heard stories of people taking a forebearance/deferrment so they can take trips. The long term ramifications of this may be more than you anticipated. Knowing the rules of the game allow us to play with both eyes open. It is easy to understand how student loan debt can quickly get out of hand especially if you are trying to ease the burden month-to-month.
