Federal Student Loans: What Happens If You Don't Pay? [POLICYbrief]

04:54
Since 1958, the United States federal government has offered loans to help college students pay for their education. Over the past decade, however, the default rate on these loans has risen sharply, with over 25% of former students failing to repay their loans. What happens when federal student loans aren’t repaid? Student loan lawyer Adam Minsky and Jason Delisle of the American Enterprise Institute explore the troubling landscape of federal student loan repayment. As always, the Federalist Society takes no particular legal or public policy positions. All opinions expressed are those of the speakers. What is UNPAID PRINCIPAL BALANCE? What does UNPAID PRINCIPAL BALANCE mean?

01:19
What is UNPAID PRINCIPAL BALANCE? What does UNPAID PRINCIPAL BALANCE mean? UNPAID PRINCIPAL BALANCE meaning - UNPAID PRINCIPAL BALANCE definition - UNPAID PRINCIPAL BALANCE explanation. Source: Wikipedia.org article, adapted under https://creativecommons.org/licenses/by-sa/3.0/ license. Unpaid principal balance (UPB) is the portion of a loan (e.g. a mortgage loan) at a certain point in time that has not yet been remitted to the lender. For a typical consumer loan such as a home mortgage or automobile loan, the original unpaid principal balance is the amount borrowed, and therefore the amount the borrower owes the lender on the origination date of the loan. The unpaid principal balance will decrease as time goes on for the loans that are structured with level payments. For these common loans, each monthly payment includes both interest and principal. The unpaid principal balance at the beginning of a given month is reduced by that portion of the level payment that is designated principal for that month; so that the unpaid principal balance at the end of the month is the beginning UPB less the principal paid for the month. Hence, the UPB decreases over time.

Accrued Expenses Definition - What are Accrued Expenses?

03:47
Accrued expenses definition including break down of areas in the definition. Analyzing the definition of key term often provides more insight about concepts. The term accrued expenses can be defined as: Costs incurred in a period that are both unpaid and unrecorded; adjusting entries for recording accrued expenses involve increasing expenses and increasing liabilities. Accrued expenses are those that have been incurred but have not been recorded or paid as of the cutoff date. Wages payable is a common example of accrued expense because the process of paying wages is usually best set up on more of a cash basis with the plan of adjusting at the end of the period. The accrued expense adjustment would be a debit to wages expense for the amount of work done before the cutoff that has not yet been paid and a credit to wages payable. Loan interest can be an example of accrued expense because we may have interest owed that is not due to be paid until after the cutoff. Taxes payable can be another example of accrued expenses. Collection agencies are the biggest scam. I've seen these companies ruined lots of families lives by simply lying to them about paying a bill. the truth is that a collection account is negative on your report and paying the account is equally as bad because they will not remove the account, as a matter of fact, this will restart the timeframe in which an account remains on your report. A collection account showing up as paid is still negative as the credit scoring models are designed to pick that up as a negative account. this is still a negative reflection on your paying habits and finance companies just don't trust that. 3 Reasons Why You Should Not Pay Your Debt

01:13
Paying off an old collection or charge off will increase your credit score. This is a huge MYTH! Effects of Paying When you pay an older collection account or charge-off account, your credit score most likely will suffer. Think twice before paying off an old collection or charge off. By paying your debt, it renews the date of last activity. The collection company or creditors can now report the account for another 7 years. Everyone knows debt collections are bad for your credit score. Any past due accounts including debt collections have negative effects. These accounts report on your credit report for up to7 years. As accounts age, they have less and less impact on your credit score. Many consumers believe by paying off collections or charge-off accounts, that it will raise their credit scores. It certainly seems logical; however it is far from the truth. If you are concerned about your credit score, paying off debts prior to obtaining any other type of loan or mortgage can greatly hurt your credit score. Ultimately, if it is an older account when paid off (or payments are made on the account), by doing so can be devastating to ones credit score. The recent activity of any derogatory item has a big impact on how it effects your overall credit score. Is the Debt Still Valid? After a certain period of inactivity on an account, a debt becomes time-barred and debt collectors can no longer sue you for it. This period is known as "the statute of limitations on debt" and varies by state. If the statute of limitations has passed, it is illegal for a debt collector or creditor to sue you. You need to be careful in communicating with a debt collector because the debt statute of limitations can easily be restarted by acknowledging that you owe the debt, making a payment, entering a payment plan, making an agreement to pay or making a charge on the account. After 7 Years Collection and charge-off accounts should only remain on your credit report for 7 years. It is important to check your credit reports as the credit bureaus often continue reporting these derogatory accounts over the 7 year limit. If you have any questions regarding collection accounts on your credit reports, call our office today for your complimentary credit consultation. We look forward to hearing from you. 480-502-5554 LEGAL DISCLAIMER: The advice provided is for informational purposes only. It is not to be construed as Legal Counsel or Legal Advice.

Put it all together to determine your interest charge for the month Paying more than the minimum each month will lower your interest charges. What happens if you don't pay a bank loan? | By Ishan [Hindi]

06:11
What happens if you don't pay a bank loan? | By Ishan [Hindi] First thing you have to understand that bank would not foreclose the loan even if you defaulted on one or two EMI payments. In fact foreclosure has always been the last option which banks wants to exercise. But yes if you continue to default for 3 months then there is a high probability that bank will seize your property. Banks have their set procedure in such cases. They don’t bother you after the first EMI default, but when you don’t pay 2 EMIs consecutively, they will send you a reminder to pay. It is only after 3 consecutive months of default that banks treat loan as NPA. Thus after 3 defaults banks can enforce, “The Securitization and reconstruction of financial assets and Enforcement of Security Interest act’2002” ( SARFAESI)” and start the process of recovery of property/dues. After three months bank will send you a legal notice and ask you to repay the dues. If you don’t repay at this stage too, then after two months (i.e. five months from the first default) bank will send you notice that it has valued the property for certain amount and will be auctioning the same. Auction date is set for generally 1 month after the date of notice. You have to understand that bank itself does not want to go through this cumbersome process of auctioning and wants to settle things as soon as possible. If you look at the process, then banks give sufficient six months of time before auctioning the house. Within these six months you can approach anytime and try to settle the things out with bank. Personal Loan: If you Can’t pay your Personal loan then the days of trouble is started for you. Basically personal loans are unsecured loan that means you don't have to provide any security so bank can’t seize your property to recover the loan amount. Initially Bank or lenders gives you a time span to start repaying your loan but in case that limit is over pass then bank will take a legal action and file a case against you under section 58. So in this case best thing that an employer can do is, talk to your lender and ask for 10 or 20 days of relaxation then start repaying your personal loan as soon as possible. If you are thinking about taking a new personal loan and you are afraid that what will happen if you failed in paying off personal loan. In this case i have a personal suggestion Just choose a NBFC to take a personal loan over any bank. Because NBFCs are quite flexible in these type of cases. Invoices Not Paid On Time 😡 | Freelance Digital Marketing Life | July 2018

08:45
Freelance Digital Marketing Life throws up some interesting challenges. So for this month I wanted to speak about 1 specific topic. These links will help: Late Payment Fees: https://www.gov.uk/late-commercial-payments-interest-debt-recovery Charging Interest: https://www.gov.uk/late-commercial-payments-interest-debt-recovery/charging-interest-commercial-debt Late Payment Calculator: https://dontpaylate.uk/ July 2018 in the world of digital marketinghas been incredibly busy and a lot of the new work that I’ve taken on has come from my website. New people, from up and down the country who are totally new to me. Normally, clients for digital marketing work come in via word of mouth recommendations so they’re not complete strangers. Now here comes the interesting bit. Invoicing is not a fun topic but is super important. If freelancers don’t invoice then freelancers don’t get paid. What I wanted to talk about was that one of these clients who I didn’t know hadn’t paid their bill. Normally there can often be a very good excuse. People go down ill, people go on holiday. But in this instance the client I was working with had disappeared – and it sucked as it was the first time I’ve experienced so far when a client hasn’t paid. So if you have a client or supplier who is late in paying their bills then this is the process I went through which hopefully might help some of you out there. Firstly, I made sure I contacted them and made it clear that if I didn’t hear from them I would escalate the situation. Don’t keep waiting for an answer though. Next, and this applies to UK law – it depends on how much the invoice is for but if your invoice is late you can charge a late payment fee as well as interest on how long the invoice hasn’t been paid for. I updated the invoice and sent it back to client highlighting that if the payment wasn’t made then it would be escalated further… If it came to it I could have taken the client to small claims court. The amount you have to pay for starting the procedure varies depending on how much you’re invoicing for. Fortunately though I didn’t have to do this as they paid up – but it was still a frustrating, time consuming process. At the same time I did put a message out on LinkedIn and got some really positive feedback on other ways I could have approached it. As a result of this there are a number of organisations and individuals who will work to collect the amount due and take a cut of the invoice so you only have to pay on completion – but through LinkedIn there are plenty of horror stories out there from other freelancers. Although a lot of it was my stupid mistake I’ve decided that in the event of taking on a new client who isn’t known to me will mean that I invoice 50% of the bill up front and the remainder on completion. It also means that the work then becomes guaranteed. It also means that I’m going to be updating my business terms and conditions to cover myself. In an ideal world I don’t want to be that guy lays down a heap of terms and conditions when at the end of the day the client wants to work with me and I want to work with them. However, if a client doesn’t pay then that puts my livelihood on the line and that isn’t something which I am willing to compromise. So I hope that helps – as always if you have any questions about what digital marketing life is like or what freelancing life is like then do stick a question in the comments below. Thanks for watching!

Amortization (Overview)

02:38
Amortization - Full lessons and CE Credit available here - https://www.trevorcalton.com/videos Hi, this is Trevor Calton and today we're talking about amortization. Amortization is the term for paying down the cost of an asset at a certain rate. In the real estate world, typically when we're referring to amortization we are referring to the rate at which we are repaying the principal on a loan back to the lender. Let's take a look at this graphically. Imagine that we have our loan amount and time, let's say this is 30 years. If a loan is fully amortizing, it is paid off down to zero at the end of the life of the loan. It starts out at whatever the loan amount is and a fully amortizing loan is paid completely off. The most common example of a fully amortizing loan would be your standard 30 year fixed rate home loan. You have an equal payment that goes every month for the entire life of the loan and at the very last payment the loan balance is zero. Sometimes we have what's called a partially amortizing loan and that would be when the loan is paid down but not all the way. In the case of a partially amortizing loan, we end up with a balloon payment. Typically when you find a partially amortizing loan it is often because payments are amortized over say 25 or 30 years, but the term of the loan is shorter and we have a balloon payment say after maybe 10 or 15 years. The next type of structure is no amortization. In other words, not paying any principal at all, we're simply paying interest only. The loan balance at the beginning of the loan never changes, it stays constant throughout the life of the loan because payments are only made to cover interest and not paying down any principal. Finally, sometimes we run into what we call negative amortization. Typically negative amortization occurs when payments are not sufficient to cover even the interest that has accrued each month or each period and any unpaid interest is capitalized onto the balance, thereby increasing the loan amount and the loan balance over time. This has been a quick overview of amortization. Thanks for watching.

They got me! Capitalized Student Loan Interest | Making Cents | $7,291

02:08
In today's video we are talking about capitalized student loan interest. When a loan is capitalized, it means the unpaid accrued interest is added to the principal. Then the interest starts earning interest. Talk about the wrong kind of snowball. Did you know for unsubsidized student loans there are many times throughout the life of a loan that interest can be capitalized: -Out of grace/ Out of school -End of deferrement or forebearance -When a loan is in default -When a loan is consolidated AND when you switch between payment plans. This is where they got me. I didn't realize that going between the different income based repayment plans (IBR, REPAYE, ICR etc) counts. So last year, when I went from an IBR plan to another IBR plan- guess what happened? WHAM! Interested capitalized. I was soo upset but I promised myself that wouldn't happen again. Knowledge is power. I share this information so that we make informed decisions. I know there are times when a forebearance or deferrment is necessary due to circumstances but I've heard stories of people taking a forebearance/deferrment so they can take trips. The long term ramifications of this may be more than you anticipated. Knowing the rules of the game allow us to play with both eyes open. It is easy to understand how student loan debt can quickly get out of hand especially if you are trying to ease the burden month-to-month. Using State Funds to Lower Interest Payments on Past Due Bills

16:02
State Capitol: We go one-on-one with State Treasurer Mike Frerichs to hear his plan on how the state can both earn twice as much interest on its reserve funds while lowering the interest payments the state is currently making on its past due bills. The state is required to pay approximately 12% on unpaid bills that are over 60 days past due. With the state owing billions of dollars in past-due bills, the interest payments alone can be hundreds of millions of dollars each year. These interest payments are often paid out to firms that borrow at low-interest rates from banks, pay off the vendors' bills, and then collect the payment AND the 12% interest due from the state. Treasurer Frerichs looks to have the state use its own reserve funds to pay off bills and then collect a portion of the interest the state now pays out.

Source: Wikipedia.org article, adapted under https://creativecommons.org/licenses/by-sa/3.0/ license. In finance, negative amortization (also known as NegAm, deferred interest or graduated payment mortgage) occurs whenever the loan payment for any period is less than the interest charged over that period so that the outstanding balance of the loan increases. As an amortization method the shorted amount (difference between interest and repayment) is then added to the total amount owed to the lender. Such a practice would have to be agreed upon before shorting the payment so as to avoid default on payment. This method is generally used in an introductory period before loan payments exceed interest and the loan becomes self-amortizing. The term is most often used for mortgage loans; corporate loans with negative amortization are called PIK loans. Amortization refers to the process of paying off a debt (often from a loan or mortgage) over time through regular payments. A portion of each payment is for interest while the remaining amount is applied towards the principal balance. The percentage of interest versus principal in each payment is determined in an amortization schedule. Negative amortization only occurs in loans in which the periodic payment does not cover the amount of interest due for that loan period. The unpaid accrued interest is then capitalized monthly into the outstanding principal balance. The result of this is that the loan balance (or principal) increases by the amount of the unpaid interest on a monthly basis. The purpose of such a feature is most often for advanced cash management and/or more simply payment flexibility, but not to increase overall affordability. Neg-Ams also have what is called a recast period, and the recast principal balance cap is in the U.S. based on Federal and State legislation. The recast period is usually 60 months (5 years). The recast principal balance cap (also known as the "neg am limit") is usually up to a 25% increase of the amortized loan balance over the original loan amount. States and lenders can offer products with lesser recast periods and principal balance caps; but cannot issue loans that exceed their state and federal legislated requirements under penalty of law. A newer loan option has been introduced which allows for a 40-year loan term. This makes the minimum payment even lower than a comparable 30-year term.

Stop Paying Your Student Loans CEPersVid-53

08:07
Millions of students are needlessly paying their student loans which are "under water" -- i.e., where the amount owed is greater than the value of the higher education purchased with the loans. Borrowers can't earn enough to pay their student loans and pay for their reasonable living expenses. The borrowers should do what homeowners do when their mortgages are under water -- which is to stop paying their loans, get into a court setting, and negotiate for a reduced loan (in principal amount as well as monthly interest). Attorney Carl Person also produced the first and successful video "Stop Paying Your Mortgage!". Although government student loans are almost impossible to shed in bankruptcy, you can go into court by suing your banks to terminate the student loans on various legal grounds and expect to have an opportunity to settle your case in a way that eliminates or substantially reduces your loan, depending on the facts of your case. Get rid of student loans by stopping payment; suing the banks, and then settling the lawsuit. Stop being an economic slave to the banks.
