What to Do If a Client Won't Pay What They Owe on a Contract

What do you do if someone owes you money on a contract and they won’t pay you? Well, there are a number of things you can do yourself. The first thing you want to do is make sure you have a written contract. Do you have a written contract, signed by the person against you that you’re pursuing, saying, “I’m going to pay him a $1,000,” or, did you do work for them and you have an invoice where you sent them an account and they were supposed to pay you and they didn’t? Did you sell him something? Did you have a bill of sale or a bill of lading, and they didn’t pay you? So, first, make sure you have a written contract. If you don’t, get a written contract and make sure you do your business with written contracts. Secondly, you want to make a claim before you hire a lawyer like me and you waste your money, potentially waste your money, right? You want to see if you can settle it yourself, so call them, email them, put it in writing, make a demand. In your contract, say that if you have to sue them, you get your attorney’s fees and expenses, and that’s leverage you have against the other person. Write him a letter, write him an email, “Pay me, 30 days. Pay me, 30 days. Pay me, 30 days later.” And then you can say, “Listen, if you don’t pay me, I’m going to have to hire a lawyer and you’re going to have to pay for all of that too.” It would be amazing what that can do. And, you can also file your own claim. You can go to small claims court under $5,000. In any locale and in your county, there’s a small claims court. It’s usually a $25 filing fee. You file a petition. You fill out the form. They’ll get service. They’ll bring them into court, and you’ll get a judgment against them, and then you can try to collect against them. If it’s more than that, you can go to associate circuit court. Now when you start getting more than that, a lawyer like me can add value to the case. I’m Gary Burger. I’m with Burger Law. And, a breach of contract is a duty, a breach, inconsequential damage from them. You can get the damages as a result of that. Sometimes you can get interest, sometimes you get attorney’s fees in cost, if it’s in your contract. If it isn’t in your contract, you’re not going to get those, so you might want to put that in your agreement as I’ve already mentioned. So, if it’s a bigger case, come and talk to me. We’ll consult with you, whether or not a lawyer like me can add value to the case. What happens if you don't pay a bank loan? | By Ishan [Hindi] First thing you have to understand that bank would not foreclose the loan even if you defaulted on one or two EMI payments. In fact foreclosure has always been the last option which banks wants to exercise. But yes if you continue to default for 3 months then there is a high probability that bank will seize your property. Banks have their set procedure in such cases. They don’t bother you after the first EMI default, but when you don’t pay 2 EMIs consecutively, they will send you a reminder to pay. It is only after 3 consecutive months of default that banks treat loan as NPA. Thus after 3 defaults banks can enforce, “The Securitization and reconstruction of financial assets and Enforcement of Security Interest act’2002” ( SARFAESI)” and start the process of recovery of property/dues. After three months bank will send you a legal notice and ask you to repay the dues. If you don’t repay at this stage too, then after two months (i.e. five months from the first default) bank will send you notice that it has valued the property for certain amount and will be auctioning the same. Auction date is set for generally 1 month after the date of notice. You have to understand that bank itself does not want to go through this cumbersome process of auctioning and wants to settle things as soon as possible. If you look at the process, then banks give sufficient six months of time before auctioning the house. Within these six months you can approach anytime and try to settle the things out with bank. Personal Loan: If you Can’t pay your Personal loan then the days of trouble is started for you. Basically personal loans are unsecured loan that means you don't have to provide any security so bank can’t seize your property to recover the loan amount. Initially Bank or lenders gives you a time span to start repaying your loan but in case that limit is over pass then bank will take a legal action and file a case against you under section 58. So in this case best thing that an employer can do is, talk to your lender and ask for 10 or 20 days of relaxation then start repaying your personal loan as soon as possible. Did you know for unsubsidized student loans there are many times throughout the life of a loan that interest can be capitalized: -Out of grace/ Out of school -End of deferrement or forebearance -When a loan is in default -When a loan is consolidated AND when you switch between payment plans. This is where they got me. I didn't realize that going between the different income based repayment plans (IBR, REPAYE, ICR etc) counts. So last year, when I went from an IBR plan to another IBR plan- guess what happened? WHAM! Interested capitalized. I was soo upset but I promised myself that wouldn't happen again. Knowledge is power. I share this information so that we make informed decisions. I know there are times when a forebearance or deferrment is necessary due to circumstances but I've heard stories of people taking a forebearance/deferrment so they can take trips. The long term ramifications of this may be more than you anticipated. Knowing the rules of the game allow us to play with both eyes open. It is easy to understand how student loan debt can quickly get out of hand especially if you are trying to ease the burden month-to-month. At the crudest level, a debt represents something that must be repaid; it is the result of borrowing money. When corporations borrow, they generally promise to make regularly scheduled interest payments and to repay the original amount borrowed (that is, the principal). The person or firm making the loan is called the creditor or lender. The corporation borrowing the money is called the debtor or borrower From a financial point of view, the main differences between debt and equity are the following: Debt is not an ownership interest in the firm. Creditors generally do not have voting power. The corporation’s payment of interest on debt is considered a cost of doing business and is fully tax deductible. Dividends paid to stockholders are not tax deductible. Unpaid debt is a liability of the firm. If it is not paid, the creditors can legally claim the assets of the firm. This action can result in liquidation or reorganization, two of the possible consequences of bankruptcy. Thus, one of the costs of issuing debt is the possibility of financial failure. This possibility does not arise when equity is issued. S IT DEBT OR EQUITY? Sometimes it is not clear if a particular security is debt or equity. For example, suppose a corporation issues a perpetual bond with interest payable solely from corporate income if and only if earned. Whether this is really a debt is hard to say and is primarily a legal and semantic issue. Courts and taxing authorities would have the final say. Corporations are adept at creating exotic, hybrid securities that have many features of equity but are treated as debt. Obviously, the distinction between debt and equity is important for tax purposes. So, one reason that corporations try to create a debt security that is really equity is to obtain the tax benefits of debt and the bankruptcy benefits of equity. As a general rule, equity represents an ownership interest, and it is a residual claim. This means that equity holders are paid after debt holders. As a result of this, the risks and benefits associated with owning debt and equity are different. To give just one example, note that the maximum reward for owning a debt security is ultimately fixed by the amount of the loan, whereas there is no upper limit to the potential reward from owning an equity interest. S IT DEBT OR EQUITY? Sometimes it is not clear if a particular security is debt or equity. For example, suppose a corporation issues a perpetual bond with interest payable solely from corporate income if and only if earned. Whether this is really a debt is hard to say and is primarily a legal and semantic issue. Courts and taxing authorities would have the final say. Corporations are adept at creating exotic, hybrid securities that have many features of equity but are treated as debt. Obviously, the distinction between debt and equity is important for tax purposes. So, one reason that corporations try to create a debt security that is really equity is to obtain the tax benefits of debt and the bankruptcy benefits of equity. As a general rule, equity represents an ownership interest, and it is a residual claim. This means that equity holders are paid after debt holders. As a result of this, the risks and benefits associated with owning debt and equity are different. To give just one example, note that the maximum reward for owning a debt security is ultimately fixed by the amount of the loan, whereas there is no upper limit to the potential reward from owning an equity interest. 2/3rds of college students graduate with student loan debt. On average, graduates have about $24,000 in debt, with 10% of graduates having over $45,000 in debt. And those are just the statistics for students with a 4 year degree. Student loan debt is at an all time high, and very well may continue to rise with the increases in college costs. How should workers with student loans decide between paying down their debt while still saving for the future? Track your spending: If you frequent this blog, you know I am passionate about the benefits of tracking your spending. Anytime you are trying to balance goals such as debt payoff and saving, you need to know how much you can afford to commit to your spending plan. How much do you have each month to put towards your goals? The best way I know to determine this is to track your spending. Make at least the minimum payments: No matter what, make at least the minimum payments every month, on time, to your student loans. Student loan debt will (almost) never go away, not even in a bankruptcy. Getting behind on your student loan payments can also disqualify you for payment restructuring should you need it, such as in the event of a disability or job loss. Be sure you always make the minimum payments on time each month. Get an emergency fund: Once you are making at least the minimum payments on your student loan debt, put the rest of your available money into an emergency fund. You want to have 3-6 of monthly living expenses in a savings account just for emergencies. This way, in the event of the unthinkable happening, you will still be able to pay your bills. Take full advantage of employer match on 401(k): Next, take full advantage of your employer match on 401(k) contributions. This is free money, and the only reason to not take advantage of it is if contributing to your 401(k) would keep you from being able to make minimum payments towards your student loans, or if you don't have an emergency fund. Check with your HR department if you aren't sure if this option is available to you. Set goals: How fast do you want to be out of debt? Does the thought of being in debt stress you out, or are you comfortable carrying some debt? Sit down and make a plan for when you want to be out of student loan debt. You can then figure out how much you need to pay towards your loans each month to meet your goals. Check the interest rates: Student loans issued today have a 6.8% interest rate, while some issued prior to 2006 have interest rates below 3%. The higher the interest rate, the faster you want to pay it down. Remember, paying off a 6.8% interest rate loan is equivalent to getting a guaranteed growth rate of 6.8% if you were to invest the money. You have to find the balance that YOU are comfortable with. We all have different levels of comfort when it comes to debt and savings. In an ideal world, you will have a fully funded emergency fund, be making payments towards your student loans so they will be paid off in 3-4 years, and be saving 10%-15% of your income into your 401(k). If this simply isn't feasible for you, then find the balance that you feel comfortable with. If at all possible, always make minimum payments to your student loans, have an emergency fund, and take advantage of the employer match on your 401(k). Based on the interest rates of your student loans, put any excess money you have each month towards debt pay off or into your 401(k). So what do you think?
